Women’s Work and Globalisation: A Bibliography (1990-2011)

Dear Friends,

The CWDS Library has compiled a bibliography on "Women’s Work and Globalisation: A Bibliography (1990-2011) /compiled by Anju Vyas and Akhlaq Ahmed” under its “CWDS Library Resources Series; XI”. 

The bibliography presents material on diverse aspects of women’s work and employment in the light of changing of economic policies and globalisation. The bibliography contains the references available in the CWDS Library both published as well as unpublished in a variety of formats.

The bibliography covers the material from 1990 to 2011 and contains 668 entries. It is divided into three parts. The first part contains 367 entries from books, analytics (chapters from the edited books),reports and institutional papers while second part contains over 300 entries from periodical articles. The third part has three indexes i.e. Personal and Corporate Author Index; Keyword Index; and Geographical Area Index to facilitate easy retrieval.

We hope this effort will be helpful to those working and interested in the area of Women’s Work and Employment.

Invitation: National Consultation on ‘Strategizing Advocacy for Effective Implementation of Women Friendly Laws’ 12th July, 2012

 Greetings from Women Power Connect!

The last decade has seen many women friendly laws enacted, strengthening the efforts of women groups who have been relentlessly working towards women empowerment with justice and dignity.

Despite the numerous legal mechanisms in place, such as PWDV Act, PCPNDT Act, PCM Act etc., there is a steep increase in crime against women across the country. There is an urgent need for civil society and government departments to collectively take steps for ensuring effective implementation of these laws, so they could be made accessible to women. 

Keeping this in mind, WomenPowerConnect (WPC), with the support of National Commission for Women (NCW), organized five regional level workshops in Udaipur, Rajasthan, Bhubaneswar, Chennai, Guwahati and Chandigarh to reflect on the experiences in different states and to deliberate upon the interventions.

As a culmination of all the regional level meetings held in five regions, WPC –NCW are organizing National level Consultation on 12th July, 2012 at India Habitat Centre, Gulmohar Conference hall, Lodhi Road, New Delhi. The workshop would have representatives from NCW, other concerned government departments, State Commissions, legal experts, research institutions and Civil Society Organizations from different states.

Women has right to Husband's residence

A Delhi Sessions Court has observed that a woman cannot be denied her right to reside in the house of her husband on the allegation that she is having an extra marital affair when such allegation is yet to be established. The Court made the observation while securing the right of woman working in a private university to stay in her husband's rented accommodation. The Court ruled that she was entitled to right to residence in her husband's newly rented property till such times as the divorce case filed by him was resolved.

AIDWA statement on the Delhi High court judgments of 9-5-2012

The Delhi high court has clearly allowed Shumaila to exercise her choice of residing with her husband. It has also directed the presence of Mehtab, Shumaila and either of her in-laws once in six months, in order to ascertain her well being, till she attains the age of majority before the Child Welfare Committee.  The Committee has to take necessary steps including obtaining the necessary undertaking from Mehtab in that regard. Subject to completion of these steps, (which shall be within a week) Shumaila shall be allowed to live with Mehtab, in the matrimonial home. However, she has the option of treating the marriage as voidable, at the time of her attaining the age of majority, i.e 18 years.

The AIDWA, while accepting the judgement of the Delhi high court in this particular case,  expresses grave concern as the judgement invokes Muslim Personal laws which will sanction child marriages and lend credibility to it. Parents forcing their minor daughters to marry the boys of their choice against their wishes will be justified on the background of this judgement. In such marriages there is no monitoring by any Child Welfare committees nor does the girl have any recourse to end the marriage if she desires to do so on attaining 18 years of age.  

While AIDWA welcomes the stand adopts by the Court towards self choice marriages and also it's concern for the girls welfare it is strongly opposed to the sanction awarded to child marriage under shari'a law.  This is totally unacceptable as it will lead to arranged child marriages of Muslim girls and of course with no safeguards at all.  We cannot accept relaxation of the minimum age of marriage for Muslim girls.

Moreover, Muslim Personal laws are not codified in India and vary according to interpretations. This judgement only underscores the need for the codification of Muslim Personal laws in India in the absence of which many regressive practices are sought to be justified.

The AIDWA expresses its grave concern at the judgement delivered by the Delhi High court regarding marriageable age for Muslim girls, which in effect condones child marriage amongst them. Despite scientific studies underlying 18 years as the suitable minimum age of marriage for girls, the fact that the High Court has delivered this regressive judgement invoking Muslim Personal Laws is a setback for women’s rights, and would impact adversely on the muslim girls’ access to education, and increase her vulnerability to maternal mortality and morbidity. While the question of defending individual choice in marriage is important, the possibility of informed consent by a 15 year old girl is by itself highly suspect and cannot be upheld as a norm. The judgement sets an unfortunate precedent, which may pave way for child marriages in India in the guise of a girl’s consent. Moreover, Muslim Personal laws are not codified in India and vary according to interpretation. This judgement only underscores the need for the codification of Muslim Personal Laws in India in the absence of which many regressive practices are sought to be justified. The HC has belied our hopes that the courts will help the process of gender justice for all. AIDWA appeals to the Delhi High Court to review its verdict in this regard.
